These terms are the agreement between you and Swimbooker Ltd for the use of watercraft. They are written to be read, not skimmed. By downloading or using the app, you agree to them. If you do not, please don't use watercraft.
watercraft is provided by Swimbooker Ltd, a company registered in England and Wales ("we", "us", "our"). "watercraft", "the app" or "the service" means the watercraft mobile application and watercraft.app. "You" means the person using it.
You must be at least 18 years old to use watercraft. By using it, you confirm that you are. The service is intended for personal, non-commercial use by anglers.
watercraft requires an account, because everything in it is your private record and is synced to that account. You are responsible for keeping your login details safe and for activity under your account. Give us accurate information, and let us know at hello@watercraft.app if you think your account has been compromised.
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use watercraft for your own angling, in line with these terms. You may not copy, resell, reverse-engineer, or attempt to extract our data or source, or use the app to build a competing product.
watercraft is free to download. Some features require paid access:
Where you buy inside the app, payment is taken by Apple (App Store) or Google (Google Play) through your store account, under their terms. Where you subscribe on the web, payment is taken by our provider, Stripe. A web subscription lets you sign in and use the app; you do not need to buy again inside the app.
Renewal and cancellation. An auto-renewing subscription continues until you cancel it. It renews automatically unless you cancel at least 24 hours before the end of the current period. You manage or cancel a store subscription in your App Store or Google Play account settings; you manage a web subscription through the link in your account or by contacting us.
Prices and changes. Prices are shown before you buy. We may change prices for future periods; where we do, we will give you notice and you can cancel before the change takes effect.
Refunds. Purchases made through Apple or Google are subject to their refund policies, and refunds for those are handled by them. For web subscriptions, contact us and we will deal with your request in line with your legal rights.
Use watercraft lawfully and sensibly. You agree not to:
The records you create in watercraft — your waters, sessions, catches, spots, notes and photos — are yours. We do not claim ownership of them. You grant us only the limited permission we need to store, back up and display that content to you so the app can work, and to sync it to your account across your devices. watercraft is not a social platform: your content is private by default and is not published or shown to other users. You are responsible for the content you add and for having the right to add it.
Lake maps, venue details and any patterns the app surfaces are provided for general reference and convenience. They may be incomplete or inaccurate, and they are not a navigational, safety or depth-charting tool. Always use your own judgement and follow the rules of the venue you are fishing. Angling carries risks near water; you are responsible for your own safety and conduct.
The watercraft app, its name, branding, design, lake-map artwork and underlying database are owned by Swimbooker Ltd or our licensors and are protected by law. Nothing in these terms transfers any of those rights to you beyond the licence to use the app described above.
watercraft relies on third-party services, including the App Store, Google Play, Stripe and Google Maps Platform. Your use of those is also governed by their terms, and we are not responsible for them. Where you obtained the app through a store, that store's rules also apply to your download and any in-app purchase.
We work to keep watercraft available and improving, but we do not guarantee it will be uninterrupted or error-free. We may update, change or remove features, and we may set reasonable limits on use, to keep the service working well.
The app is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties not expressly set out in these terms. This does not affect any rights you have as a consumer that cannot be excluded under law.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, we are not liable for loss that is not a foreseeable result of our breach, for lost data you have not backed up where we were not at fault, or for loss arising from your own misuse of the app. Where we are liable to you, our total liability is limited to the amount you paid us for the app in the twelve months before the claim.
You can stop using watercraft at any time and delete your account from Profile → Privacy & Data → Delete account. We may suspend or end your access if you breach these terms or use the app in a way that harms the service or other users. If we end your access without good reason and you have paid for a period you can no longer use, we will refund the unused part.
We may update these terms from time to time. When we make a material change we will update the date above and, where appropriate, tell you in the app. Continuing to use watercraft after a change means you accept the updated terms.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home nation. Your statutory consumer rights are not affected.
